Terms of Service

CitationPack is operated by VerityWorks LLC, a California limited liability company. By using CitationPack, you agree to these terms.

What this service is

CitationPack provides OSHA citation deadline calculations, penalty arithmetic, public-record comparables, and informal-conference preparation materials based on the information you submit and public OSHA/DOL data.

What this service is not

CitationPack is not a law firm and does not provide legal advice, legal representation, or a guarantee of any OSHA outcome. No attorney-client relationship is created. Consult qualified counsel for willful, repeat, fatality/catastrophe, high-penalty, contested, or litigation-bound matters.

Eligibility and business use

CitationPack is a business tool for employers and their representatives handling federal OSHA citations. By using it you confirm that you are at least 18 years old, that you use the service on behalf of a business and not for personal, family, or household purposes, and that you have authority to bind that business to these terms.

Your responsibility

• You are responsible for the accuracy of citation details, receipt dates, employer profile answers, and uploaded documents.
• You remain responsible for contest, settlement, abatement, and compliance decisions, and for verifying deadlines against your own records and OSHA correspondence.
• Do not upload documents or personal data that are not needed for citation triage, and do not upload content you lack the right to share with us.

Acceptable use

• Use the service only for lawful purposes and your own (or your client’s) OSHA citations.
• Do not scrape, bulk-download, resell, or offer the service or its outputs as your own competing service.
• Do not probe, disrupt, reverse engineer, or circumvent security, rate limits, payment, or access controls.
• Do not upload malware or content that infringes the rights of others.
• We may suspend or refuse service to protect the service, other customers, or ourselves.

Your content and our intellectual property

You retain all rights to the documents and information you submit, and you grant VerityWorks LLC a limited license to process them solely to provide and support the service. The service, its software, templates, report formats, and branding are the property of VerityWorks LLC or its licensors; your purchased report is licensed to you for your business’s internal use, including sharing it with your counsel and advisors. If you send us feedback, we may use it without obligation to you.

Payments and support

Payments are processed by Stripe. We do not store full card details. Prices may change, but the price shown at checkout is the price you pay for that report. If a charge or report delivery problem occurs, contact support@citationpack.com; failed or defective report generations are reviewed for regeneration or refund. Except as described above or required by law, fees are non-refundable once your report is delivered.

No warranties

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITYWORKS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that outputs will be complete, current, uninterrupted, error-free, or accepted by OSHA or any other party, and you do not rely on the service as a substitute for legal advice or your own verification.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITYWORKS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PENALTIES, FINES, OR MISSED DEADLINES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS ($100). These limits apply regardless of legal theory, are an essential basis of the bargain, and apply even if a remedy fails of its essential purpose. Where applicable law does not allow a particular limitation, that limitation applies to the fullest extent permitted.

Your indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless VerityWorks LLC and its members, officers, and employees from third-party claims, damages, and reasonable costs (including attorneys’ fees) arising from the content you upload, your use of the service or its outputs, your OSHA matter and related decisions, or your violation of these terms or applicable law.

Dispute resolution, arbitration, and class action waiver

These terms are governed by California law and the Federal Arbitration Act. Any dispute will first be submitted to good-faith informal resolution by emailing support@citationpack.com with a description of the issue; most issues are resolved this way. If a dispute is not resolved within 60 days, it will be resolved by binding arbitration before a single arbitrator in California (or by videoconference), except that either party may bring an individual claim in small claims court or seek injunctive relief in court for intellectual-property infringement or misuse of the service, and except where applicable law requires a different forum.

BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT DISPUTES MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS — NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If the class waiver is found unenforceable for a particular claim, that claim (and only that claim) proceeds in court. You may opt out of arbitration by emailing support@citationpack.com with the subject "Arbitration opt-out" within 30 days of first accepting these terms; opting out does not affect any other provision.

Time limit on claims

To the extent permitted by law, any claim relating to the service must be filed within one year after the claim accrues, or it is permanently barred.

Termination and suspension

We may suspend or terminate access for violation of these terms, suspected fraud or abuse, or risk to the service or other customers, and you may stop using the service at any time. Reports you have paid for remain available per the delivery and retention terms. Provisions that by their nature should survive — including content licenses, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.

Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including outages of hosting, payment, email, or government data providers, internet disruptions, labor disputes, natural disasters, or acts of government. Deadlines on your citation are unaffected by any such event — always verify them independently.

Changes to these terms and the service

We may update these terms or change, suspend, or discontinue features as the product evolves. Material changes will be reflected in the effective date above, and continued use after a change constitutes acceptance. The terms in effect when you purchase a report govern that purchase.

Miscellaneous

These terms and the policies they reference are the entire agreement between you and VerityWorks LLC about the service. If any provision is found unenforceable, the rest remains in effect, and a failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries. We may send notices to the email address you provide, and you may send notices to support@citationpack.com.
